TERMS OF SERVICE: J&J LANKA GEMSTONES

OVERVIEW This website is operated by J&J Lanka Gemstones. Throughout the site, the terms “we”, “us” and “our” refer to J&J Lanka Gemstones. We offer this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By accessing our site and/or purchasing a gemstone from our collection, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional policies referenced herein and/or available by hyperlink.

SECTION 1 – ELIGIBILITY

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence (18 years of age in Australia). You may not use our products for any illegal or unauthorized purpose, nor may you, in the use of the Service, violate any laws in your jurisdiction.

SECTION 2 – ACCOUNT AND INFORMATION ACCURACY

You agree to provide current, complete, and accurate purchase and account information for all transactions. You are solely responsible for maintaining the confidentiality of your account credentials. J&J Lanka Gemstones shall not be held liable for any loss or damage arising from your failure to maintain account security.

SECTION 3 – NATURAL VARIATION OF GEMSTONES

As we specialise in all-natural, earth-mined gemstones, you acknowledge and agree to the following:

  • Unique Characteristics: No two gemstones are identical; each stone possesses unique color saturation, inclusions, and internal characteristics.

  • Visual Representation: While we employ professional macro-photography to represent stones accurately, digital displays may vary. Actual color and luster may differ slightly based on your monitor settings and ambient lighting.

  • Artisanal Craftsmanship: Our stones are precision-cut in our family lapidary. Minor dimensional variations are a hallmark of artisanal hand-cutting and are not considered defects.

SECTION 4 – PRODUCTS AND AUTHENTICITY

J&J Lanka Gemstones takes pride in a direct supply chain. All gemstones are ethically sourced from Sri Lanka and processed through our family-owned facilities. We reserve the right, but are not obligated, to limit the sales of our products to any person or geographic region and may exercise this right on a case-by-case basis.

SECTION 5 – ORDERS AND CONTRACT FORMATION

Your order constitutes an offer to purchase. A binding contract is only formed once J&J Lanka Gemstones issues a formal shipping confirmation email. We reserve the right to refuse or cancel orders that, in our sole judgment, appear to be placed by dealers, resellers, or unauthorized distributors. Due to the high-value nature of rare gemstones, cancellations cannot be accommodated once an order has entered the dispatch phase.

SECTION 6 – PRICING AND TAXES

Prices for our products are subject to change without notice. All prices are listed in AUD unless otherwise specified. For Australian domestic orders, GST is included where applicable. International customers are solely responsible for any import duties, customs fees, or local taxes imposed by their respective destination countries.

SECTION 7 – SHIPPING, INSURANCE, AND RISK

Shipping lead times are estimates and subject to carrier operations and customs processing. Title and risk of loss for all items pass to the purchaser upon our delivery of the goods to the shipping carrier. We strongly recommend that customers select Fully Insured Shipping for high-value acquisitions. J&J Lanka Gemstones is not liable for delays caused by third-party couriers or customs clearance procedures.

SECTION 8 – INSPECTION AND CONDITION VERIFICATION

To maintain the integrity of our collection, every gemstone is inspected, photographed, and video-recorded under 10x magnification immediately prior to sealing.

  • Mandatory Claim Protocol: To report a defect or shipping damage, you must provide a continuous, unedited unboxing video within 24 hours of delivery showing the courier seal being broken.

  • Claims submitted without this supporting evidence will not be accepted.

SECTION 9 – RETURNS AND REFUNDS

Due to the rarity and high value of our inventory, we do not accept returns or exchanges for:

  • Items damaged, chipped, or altered after delivery.

  • Stones damaged during the setting or mounting process by third-party jewelers.

  • "Change of mind" purchases. We encourage all clients to review laboratory certifications and high-resolution media provided prior to purchase.

SECTION 10 – AUSTRALIAN CONSUMER LAW

Our products come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. These Terms do not exclude, restrict, or modify any statutory rights that cannot be excluded under the ACL.

SECTION 11 – USER CONTENT AND FEEDBACK

If you submit suggestions, reviews, or creative ideas, you grant J&J Lanka Gemstones a perpetual, royalty-free license to edit, publish, and distribute such content in any medium.

SECTION 12 – THIRD-PARTY SERVICES

We may provide access to third-party tools (such as shipping trackers or payment gateways) or links. We do not monitor these services and bear no liability for transactions or content provided by third parties.

SECTION 13 – INTELLECTUAL PROPERTY

The Service and its original content, including gemstone imagery, descriptions, branding, and logos, are the exclusive property of J&J Lanka Gemstones. Unauthorized reproduction or commercial exploitation of any site material is strictly prohibited.

SECTION 14 – PROHIBITED USES

You are prohibited from using the site: (a) for any unlawful purpose; (b) to infringe upon our intellectual property rights; (c) to submit false or misleading information; or (d) to engage in fraudulent activities regarding gemstone origin or payment.

SECTION 15 – AUTOMATED ACCESS AND DATA SCRAPING

The use of automated systems, bots, or AI agents to access the site for the purpose of data scraping, price manipulation, or commercial exploitation is strictly prohibited and will be treated as a breach of security.

SECTION 16 – DISCLAIMER OF WARRANTIES

We do not guarantee that the Service will be uninterrupted, timely, or error-free. You agree that from time to time we may remove the service for indefinite periods or cancel the service at any time, without notice to you.

SECTION 17 – LIMITATION OF LIABILITY

In no case shall J&J Lanka Gemstones, our directors, or employees be liable for any injury, loss, or consequential damages of any kind—including lost profits or replacement costs—arising from your use of any of our products.

SECTION 18 – INDEMNIFICATION

You agree to indemnify and hold harmless J&J Lanka Gemstones and our affiliates from any claim or demand, including reasonable legal fees, made by any third party due to your breach of these Terms.

SECTION 19 – SEVERABILITY

In the event that any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law.

SECTION 20 – TERMINATION

These Terms are effective unless and until terminated by either you or us. We may terminate this agreement at any time without notice if, in our sole judgment, you fail to comply with any term or provision of these Terms.

SECTION 21 – GOVERNING LAW

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Tasmania, Australia.

SECTION 22 – ACKNOWLEDGEMENT OF COUNTRY

J&J Lanka Gemstones acknowledges the Traditional Owners of the land on which we work, the palawa people of lutruwita (Tasmania), and pays respect to Elders past, present, and emerging.

SECTION 23 – CHANGES TO TERMS

We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms by posting updates to our website. It is your responsibility to check our website periodically for changes.
